The economic stimulus package recently signed by President Obama will impact COBRA Administration and payroll tax requirements. This change will require employers to identify workers involuntarily terminated from employment, between September 1, 2008 and December 31, 2009. These eligible individuals will receive a 65% subsidy of the COBRA premium for up to nine months. Using the quarterly 941 (or other applicable) Payroll Tax Return(s), employers could receive a credit for all subsidy payments made on behalf of COBRA participants.
